TL;DR: A Special Needs Trust (SNT) lets you leave assets to a disabled family member without cutting off their government benefits. Done wrong, even a small inheritance can eliminate Medicaid coverage. We build SNTs that are legally compliant, properly funded, and designed to last a lifetime.

What We Do

Comprehensive special needs planning for Alabama families caring for a loved one with a disability.

Third-Party Special Needs Trusts

Created by a parent, grandparent, or other family member to benefit a person with a disability. Assets in the trust do not affect SSI or Medicaid eligibility. No payback provision to the state at death.

First-Party (Self-Settled) SNTs

Used when a disabled person receives a personal injury settlement, inheritance, or other funds in their own name. Allows them to retain benefits while using the funds for supplemental needs. Requires Alabama Medicaid payback at death.

Pooled Special Needs Trusts

Administered by nonprofit organizations. A cost-effective option for smaller estates or when an individual trustee is not appropriate. Alabama has approved pooled trust options available.

Trustee Selection and Guidance

We help you choose the right trustee, individual, professional, or corporate, and draft the trust with clear distribution standards that protect benefit eligibility without restricting your loved one’s quality of life.

ABLE Account Coordination

ABLE accounts allow individuals with disabilities to save up to an annual limit set by federal law without affecting SSI. We coordinate ABLE account planning with your SNT to maximize available resources.

Letter of Intent and Life Care Planning

A legally non-binding but critical document that tells future trustees exactly how to care for your loved one, medical needs, routines, preferences, and emergency contacts. We guide families through this process.

How the Process Works

A structured process so nothing is missed and your loved one is protected from day one.

Benefits Review

We identify every government program your loved one currently receives or may qualify for, SSI, Medicaid, SNAP, housing, and map out the rules that govern each one.

Trust Design

We draft an SNT tailored to your family’s situation: trust type, trustee selection, distribution standards, and coordination with your overall estate plan.

Funding Strategy

We advise on how to fund the trust, life insurance, direct gifting, IRA beneficiary designation, proceeds from the family home, so assets transfer cleanly without triggering benefit loss.

Integration with Your Estate Plan

Your will, any revocable trust, and beneficiary designations are updated so every asset flows correctly into the SNT at your death, not directly to your loved one.

Letter of Intent

We help you document your loved one’s daily life, care needs, and wishes so the trustee has a complete picture, not just a legal document.

Ongoing Support

Laws change. Benefits rules change. We offer periodic reviews to keep the SNT compliant and update the plan as your family’s situation evolves.

Frequently Asked Questions

Common questions Alabama families ask about special needs trust planning.

Will a Special Needs Trust disqualify my loved one from Medicaid or SSI?

A properly drafted third-party SNT does not count as a resource for Medicaid or SSI purposes. Your loved one continues to receive benefits, and the trust supplements those benefits without replacing them. Improperly drafted trusts, or direct gifts, can trigger disqualification.

What is the difference between a first-party and third-party SNT?

A third-party SNT is funded with someone else’s money, typically a parent’s estate. It has no Medicaid payback requirement. A first-party SNT is funded with the disabled person’s own money (such as a personal injury settlement) and does require repayment to Alabama Medicaid at the beneficiary’s death.

Can I just leave money directly to my child with a disability?

You can, but it can cause serious harm. A direct inheritance above $2,000 will typically disqualify an SSI recipient and may disrupt Medicaid coverage. Even well-meaning relatives, grandparents, aunts, uncles, who leave money directly can unknowingly eliminate your loved one’s benefits.

Who should serve as trustee of a Special Needs Trust?

The trustee must understand both the legal requirements of SNT administration and your loved one’s day-to-day needs. Options include a trusted family member, a professional trustee, a corporate trust department, or a nonprofit pooled trust. We walk through the tradeoffs with every family.

What can SNT funds be used for?

Supplemental needs, expenses that improve quality of life beyond what government programs cover. This includes education, recreation, technology, transportation, therapies, travel, and personal care items. Distribution must not replace benefits the government would otherwise pay.

What is an ABLE account and how does it work with an SNT?

An ABLE account (Achieving a Better Life Experience) allows individuals with disabilities to save, up to an annual limit set by federal law, tax-free without affecting SSI or Medicaid. It works alongside an SNT, the SNT holds larger assets while the ABLE account gives the beneficiary more day-to-day flexibility.

Does Alabama have specific rules for Special Needs Trusts?

Yes. Alabama Medicaid has specific rules about what makes an SNT compliant. First-party trusts must meet federal requirements under 42 U.S.C. 1396p(d)(4). We draft trusts that meet both Alabama and federal standards to avoid benefit disruptions.

How much does a Special Needs Trust cost?

Our fees depend on complexity, whether we are drafting a standalone SNT or integrating it into a full estate plan. We quote a flat fee after your strategy session so you know the full cost before committing. Schedule a session to discuss your family’s situation.
